TRACEOCAD Privacy Policy

ARTICLE 1 – FIELD OF APPLICATION AND OPPOSABILITY 

This document completes the general and special conditions of any contract concluded between, on the one hand, the company TRACEOCAD, registered in the Aix en Provence Trade and Companies Register under number 528 939 630 and whose registered office is located at 1544 Chemin de la Rose, in the person of its current Chairman and, on the other hand, any legal person or corporate body having recourse to the services of TRACEOCAD (hereinafter referred to as “the Client”). 

By signing this document, the Customer acknowledges that they have read this Privacy Policy in its entirety and accepts it without reservation. 

The Customer also acknowledges that this Policy is linked to the general terms and conditions of TRACEOCAD which were communicated to the Customer when ordering the Services and which the Customer accepts without reservation. 

 

ARTICLE 2 – PURPOSE 

The purpose of this Privacy Policy is to inform the Client of the processing of personal data carried out by TRACEOCAD in the context of the provision of the Services. 

 

ARTICLE 3 – PERSONAL DATA COLLECTED BY TRACEOCAD

Within the framework of its activity, TRACEOCAD is led to collect personal data within the framework of:

– customer relationship management; 

– prospect management; 

– supplier management; 

– supply and maintenance of software; 

– fight against fraud and the continuous improvement of the tools provided; 

– management of the contact form attached to the website; 

– management and sending of newsletters. 

A detailed description of these treatments is given in Articles 3.1 to 3.8. 

For these processing operations, the data controller is the company TRACEOCAD, whose contact details are given in Article 1. 

Data subjects may request from TRACEOCAD access to personal data, rectification or deletion of such data, a limitation of processing, or the right to object to processing and the right to data portability, under the conditions and within the limits provided for by the regulations in force. They may also provide instructions as to the use of their personal data after their death.  

To exercise these rights, individuals must contact Ms Mélinda Charbonnel at m.charbonnel@traceocad.fr. Any request to exercise the rights mentioned above must be accompanied by proof of identity of the person concerned. It will be processed within one month of receipt of the proof of identity. In the event of special circumstances relating to the complexity of the request or to a large number of requests to be processed, the response time may be extended by a further two months. 

Data subjects also have the right to lodge a complaint with the CNIL or with any of the authorities mentioned on the list available from the European Commission.  

 

3.1. Customer relationship management 

The purpose of the processing is to manage the relationship with the Customer. The data is used for the establishment and follow-up of contracts, accounting, invoicing, collection and sending of commercial information. 

The legal basis for the processing is the need to execute the contract concluded between TRACEOCAD and the Client. 

The categories of data collected are as follows: surname, first name, business postal address, business telephone number and possibly personal telephone number if the Customer wishes to communicate it, business e-mail address and possibly personal e-mail address if the Customer wishes to communicate it, bank details. 

The categories of persons concerned are the manager(s) if the Client is a legal entity, the Client if the latter is a legal person, and on an ad hoc basis, the Client’s employee(s) serving as TRACEOCAD’s contact person(s) in the context of the execution of the contract.   

The data is kept for the duration of the contractual relationship plus a period of five years from the end of the contractual relationship. 

The recipients likely to have access to the data are TRACEOCAD’s authorised personnel, TRACEOCAD’s subcontractors, a list of whom may be provided on request. 

TRACEOCAD guarantees the Client that the confidentiality of the data is ensured by appropriate technical and organisational measures, per the regulations in force. 

The provision of information is contractual in nature. If the information is not provided, the Client will not be able to contract with TRACEOCAD. 

 

3.2. Prospect management 

The purpose of the processing is commercial prospecting. The data is used to contact prospective customers to offer them TRACEOCAD’s services. 

The legal basis for the processing is TRACEOCAD’s legitimate interest in developing its commercial activity. 

The categories of data collected are the following: surname, first name, business postal address, telephone number, and email address. 

The categories of persons concerned are TRACEOCAD’s prospects. 

The data is kept for 3 years from the last contact with the data subject. 

The recipients likely to have access to the data are authorised members of TRACEOCAD’s staff, TRACEOCAD’s subcontractors, a list of whom can be provided on request. 

TRACEOCAD guarantees that the confidentiality of data is ensured by appropriate technical and organisational measures, per the regulations in force. 

 

3.3. Supplier management

The purpose of the processing is to manage relations with TRACEOCAD suppliers. The data is used for the establishment and/or follow-up of contracts as well as the payment of invoices. 

The legal basis for the processing is the legitimate interest of TRACEOCAD in the normal exercise of its commercial activity. 

The categories of data collected are as follows: surname, first name, business postal address, telephone number, email address, and bank details. 

The categories of persons concerned are the suppliers of TRACEOCAD.   

The data is kept for the duration of the contractual relationship plus the 5-year limitation period. 

The recipients likely to have access to the data are authorised members of TRACEOCAD’s staff, TRACEOCAD’s subcontractors, a list of whom can be provided on request. 

TRACEOCAD guarantees that the confidentiality of data is ensured by appropriate technical and organisational measures, per the regulations in force. 

 

3.5. Supply and maintenance of software 

The purpose of the processing is the use of the software for which TRACEOCAD grants user licences. The data is used to enable users to use the software per its purpose and to enable corrective and evolutionary maintenance operations. 

The legal basis for the processing is the need to execute the licence agreement concluded between TRACEOCAD and the Client as well as the legitimate interest in securing the data transmitted by users via the software. 

The categories of data collected are the following: IP address, connection logs allowing to know the duration of connection and the opened applications. 

The categories of persons concerned are all users of the software distributed by TRACEOCAD.  

The data is kept for the entire duration of the licence agreement plus the 5-year limitation period (except for connection logs, which are kept for a period of one year from the connection in question).  

The recipients likely to have access to the data are authorised members of TRACEOCAD’s staff, TRACEOCAD’s subcontractors, a list of whom can be provided on request. 

TRACEOCAD guarantees the Client that the confidentiality of the data is ensured by appropriate technical and organisational measures, per the regulations in force. 

The provision of information is contractual in nature. If the information is not provided, the Customer will not be able to use the TRACEOCAD software. 

 

3.6 Fight against fraud and continuous improvement of the tools provided

The purpose of the processing is to combat software piracy and to compile statistics in order to improve the functionality of the software. 

The legal basis for the processing is the legitimate interest of TRACEOCAD to improve its tools and to prevent or stop any fraudulent use of the latter. 

The categories of data collected are IP address, username, e-mail address, type of operating system, type of CAD platform, and commands used. 

The categories of persons concerned are all users of the software distributed by TRACEOCAD, whether authorised or not.  

The data is kept for the duration of the licence agreement plus the 5-year limitation period.  

The recipients likely to have access to the data are authorised members of TRACEOCAD’s staff, TRACEOCAD’s subcontractors, a list of whom can be provided on request. 

TRACEOCAD guarantees the Client that the confidentiality of the data is ensured by appropriate technical and organisational measures, per the regulations in force. 

The provision of information is contractual in nature. If the information is not provided, the Customer will not be able to use the TRACEOCAD software. 

 

3.7 Management of the contact form attached to the website 

The purpose of the processing is to respond to requests made via the contact form on the https://www.autofluid.fr/ and https://www.traceocad.fr/contact websites.

The legal basis for the processing is TRACEOCAD’s legitimate interest in responding to its requests and the consent that the Client expresses by using the form concerned. 

The categories of data collected are the following: name, first name, email address, postal address, and telephone number.  

The categories of persons concerned are those using the contact forms.   

The data is kept for the appropriate period, depending on the sender of the message (customers, prospects, recruitment candidates). 

The recipients likely to have access to the data are authorised members of TRACEOCAD’s staff, TRACEOCAD’s subcontractors, a list of whom can be provided on request. 

TRACEOCAD guarantees the Client that the confidentiality of the data is ensured by appropriate technical and organisational measures, per the regulations in force. 

The provision of the information is necessary. If the information is not provided, the person concerned cannot be contacted by TRACEOCAD. 

 

3.8 Management and sending of newsletters

The purpose of the processing is to send information about TRACEOCAD, its service offers or any other relevant information (advice, news commentary, etc.) to newsletter subscribers. The processing also consists of managing newsletter subscriptions and preparing newsletters. 

The legal basis for the processing is TRACEOCAD’s legitimate interest in providing such information to its Clients as well as the consent of the latter when they subscribe to the newsletter.  

The categories of data collected are the following: name, first name, and email address. 

The categories of persons concerned are those who have registered.   

The data is kept for the duration of the subscription and until unsubscribed from the mailing lists. 

The recipients likely to have access to the data are authorised members of TRACEOCAD’s staff, TRACEOCAD’s subcontractors, a list of whom can be provided on request. 

TRACEOCAD guarantees the Client that the confidentiality of the data is ensured by appropriate technical and organisational measures, per the regulations in force. 

The provision of the information is necessary. If the information is not provided, the person concerned will not be able to receive the TRACEOCAD newsletter. 

 

ARTICLE 4 – PROVISIONS APPLICABLE TO ALL PROCESSING OPERATIONS 

 

4.1. Transfer of personal data 

By signing this Privacy Policy, the Customer expressly authorises the recipients mentioned for each purpose above to have access to personal data for the corresponding purpose.   

Personal data transmitted to TRACEOCAD may be transferred to a service provider outside the European Union. 

In this context, TRACEOCAD ensures that appropriate measures have been put in place to ensure that users’ personal data is afforded an adequate level of protection. TRACEOCAD has also established a framework for its relationship with its service provider in this respect, through standard contractual clauses. 

The personal data collected by TRACEOCAD will not be marketed to third parties without the express prior consent of the persons concerned. 

 

4.2. Data security 

TRACEOCAD has put in place technical and organisational measures to ensure a level of data protection appropriate to the nature of the data and the purpose of the processing.

In particular, TRACEOCAD : 

– Subjects its staff to an obligation of confidentiality;

– Raises awareness among data handlers and has drafted a binding IT charter;

– Traces the accesses;

– Secures workstations (automatic session locking procedure, updated antivirus, firewall);

– Secures servers (access to administration tools and interfaces is limited to authorised persons only, critical updates are installed without delay, data availability is ensured); 

– Secures websites; 

– Sets regular activity backups ;

– Provides a framework for data maintenance and destruction (deletion of data from all equipment before disposal);

– Manages subcontracting (specific clauses in the subcontractors’ contracts, conditions for the return and destruction of data, effectiveness of the guarantees provided);

– Protects the premises (restricting access to the premises through locked doors) ;

However, the Client is reminded that the obligation to provide security is limited by the state of the art and that it is only an obligation of means, as TRACEOCAD cannot guarantee 100% that the data stored will not be affected.

 

5. Changes to this Privacy Policy

TRACEOCAD reserves the right to modify this Privacy Policy at any time. In the event of a change, the new version will be sent by email to the Customer for signature.
